At times when the CWCB's instream flow water rights are not being satisfied on the San Miguel River, the <br />Applicant agreed to replace its depletions in time and amount with upstream augmentation water or curtail its <br />diversions. <br />. At times when the CWCB'sinstream flow water rights on the San Miguel River, the South Fork of the San Miguel <br />River, and the Lake Fork of the San Miguel River are not being satisfied, the Applicant agrees to curtail its junior <br />diversions into Trout Lake. <br />. The Applicant also agreed to install, maintain, and monitor such measuring devices as may be required by the <br />State and Division engineer to administer the terms of the decree. <br /> <br />(5) Case No. 5-99CW149; Johu Grigsby <br /> <br />The Board ratified the statement of opposition filed in this case: at its November 22, 1999, meeting. The Board's main <br />objective in filing a statement of opposition in this case,F.as to a$sure that the Applicant replace its depletions in the same <br />time, place, and amount at which they occur during the irrigation season, and that the Applicant comply with the Upper <br />Blue River Agreement with regard to depletions that occur during the winter season. The Staff, in cooperation with the <br />Attorney General's Office, has negotiated a settlement that fully protects the Board's instream flow water rights. <br /> <br />The Board holds the following instream flow rights which could have been injured by this application: <br /> <br />Case No. <br />5-86CW217 <br />5-86CW223 <br /> <br />Stream <br />Blue River <br />Swan River <br /> <br />Amount (cfs) Appropriation Date <br />32 (5/1-10/31) 16 (\ 1/1-4/30) 3/14/1986 <br />6 3/14/1986 <br /> <br />. <br /> <br />The Applicant has agreed to the following terms and conditions that are fully protective of the CWCB's instream flow <br />water rights: <br /> <br />. The Applicant included the terms required to comply with: the Upper Blue River agreement. <br />. At times when the CWCB's instream flow water right~ are not being satisfied during the period of May 15- <br />September 15 on the Blue River or on the Swan River; Applicant will provide water to the Swan River in an <br />amount equal to the depletions, in the same time and location where those depletions impact the river system. <br />. The Applicant also has agreed to install, maintain, and monitor such measuring devices as may be required by the <br />State and Division engineer to administer the terms of the decree. <br /> <br />. <br /> <br />
