<br />. <br /> <br />. <br /> <br />. <br /> <br />. Directs the Secretary to: (1) promulgate regulations that establish criteria that must be met for <br />scientific and commercial information to be used as the basis of a determination to support <br />listing a species; and (2) identify and publish in the Federal Register with notice of a proposed <br />regulation a description of additional scientific and commercial data that would assist in the <br />preparation of a recovery plan. Prohibits the Secretary from determining that a species is <br />endangered or threatened unless field data collected supports the determination. <br /> <br />. Requires the Secretary to: (1) appoint an independent review board to review and report on the <br />scientific information and analyses on which a covered action is based before such covered <br />action becomes final; and (2) provide specified participation opportunities to any person who has <br />sought authorization of funding from a Federal agency for an action that is subject to <br />consultation regarding its effects on endangered or threatened species or habitats. <br /> <br />FEMA Digital Maps: Weare the first state agency to obtain all FEMA Flood information in a digital <br />format, including Flood Insurance Stndies, Flood Insurance Rate Maps and Floodway maps (the digital <br />information would have cost $2,000, but as we provide service to the public there was no cost). This ten- <br />disk set replaces bookshelves of hard copy reports and maps in our office and will make customer <br />service functions much easier. We plan to place all the FEMA related information on the web site as part <br />ofthe Water Resource Information Center/ imaging project. Soon the public will be able to access these <br />maps. <br /> <br />USACE Colorado Service Center New Employee: The U.S. Army Corps of Engineers (Corps) has <br />replaced Van Shipley with Sandy Rayl from the Albuquerque District. Rayl's first day was July 2 and on <br />July II we met with the Corps District project managers and Sheryl to discuss future expectations and <br />coordination. We specifically requested advanced notice of wildlife and recreational 404 permit <br />applications. Of special note, the Corps is contemplating re-promulgating their "Principles and <br />Guidelines" upon which they make permitting decisions. More stringent rules and regulation may be on <br />the horizon. Rayl is also expected to report to the board through presentations and the Director's Report. <br />You will meet her in September when she makes a budget and program presentation. Rayl's contact info <br />is posted on the Flood Section page of the CWCB web site. <br /> <br />Statewide Issues <br /> <br />Education Kiosk: The interactive education kiosk has been completed. You are welcome to play with it <br />at the meeting or when you corne to our office. It will also be used at the State Fair. <br /> <br />RICD Update: On May 31 Ted Kowalski of the Instream Flow and lake Protection Section made a <br />presentation to the Colorado River Headwaters Forwn on the current status of Recreational In-Channel <br />Diversions ("RICDs") in Colorado. <br /> <br />On June 7, Judge Ossola, of Water Division 5, issued his ruling in the RICD trials involving the <br />Breckenridge and Vail water right applications. The Judge granted the decrees in large part, but did not <br />award piscatorial rights. He also struck Breckenridge's claims for water rights where those amounts are <br />less than 100 cfs (the flow amount where white water features appear). The Board will be updated on <br />this litigation at the meeting. <br /> <br />The State filed its reply brief in the Golden appeal on June. Oral arguments will, most likely, occur in <br />the fall of2002. <br /> <br />On June 12 the Hearing Coordinator for the Upper Gunnison River Water Conservancy District RICD <br />application issued a Notice of Prehearing Conference and Deadlines. The Water Court has not yet <br />granted the extension of time for the Board to file its Recommendations and Findings with the Water <br />Court, but the Water Court is expected to grant that motion. <br />
