<br />Agenda Item 8a(6) . <br />Case No. 5-98CW084; Boxwell <br />Case Summarv . <br /> <br />The Board ratified the Statement of Opposition filed in this case at its September 21-22, 1998, <br />meeting. This is an application for a plan for augmentation on the Fraser River near the town of <br />Tabernash in Grand County (see attached map). Applicant seeks to augment out-of-priority <br />depletions associated with the Boxwell Well with water from Jamie Lake or Sunset Ridge Pond. <br />Both augmentation sources are located upstream from the Boxwell Well. Wastewater may be <br />treated by a septic system or a central wastewater system located near the town of Tabernash. <br /> <br />The Board holds an instream flow appropriation on the Fraser River for 17 cfs, summer, and II <br />cfs, winter, with an appropriation date of November 27, 1990, which may be injured by this <br />application. <br /> <br />Stipulation <br /> <br />Applicant has agreed to the following terms and conditions that will provide full protection for <br />the Board's instream flow appropriation on the Fraser River. <br /> <br />. Applicant agrees to curtail diversions to Sunset Ridge Pond at any time the <br />streamflow of the Fraser River immediately below Applicant's diversion is less than <br />the amount appropriated by the Board in Case No. 90CW31S. <br /> <br />. With regard to the plan for augmentation, Applicant has reserved the right to elect <br />whether its wastewater will be treated by on-site, evaporative septic system/leach <br />fields or by a centralized wastewater treatment facility to be built near Tabernash. In <br />the event that wastewater is treated by an on-site septic system, at any time the stream <br />flow of the Fraser River immediately below Applicant's diversion structure(s) is less <br />than the amounts appropriated by the CWCB in Case No. 90CW315, Applicant <br />agrees to either: I) replace all out of priority depletions, in time and amount, at or <br />upstream of their diversion'structures; or 2) curtail out-of-priority depletions under <br />this plan for augmentation. <br /> <br />. <br /> <br />. In the event that Applicant's wastewater is treated by a centralized wastewater facility <br />located downstream of the Applicant's point of diversions, at any time the stream <br />flow of the Fraser River immediately below Applicant's diversion structure(s) is less <br />than the amounts appropriated by the CWCB in Case No. 90CW315, Applicant <br />agrees to either: I) replace all out of priority diversions, in time and amount, at or <br />upstream of their diversion structures; or 2) curtail out-of-priority diversions under <br />this plan for augmentation. <br /> <br />. <br />
