<br />Agenda Item 8a(3) <br />Case No. 5-96CW370; Oasis Ranches . <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its March 20, 1997, meeting. This <br />is an application for surface water rights, change of water rights, and approval of plan for <br />augmentation on the Blue River near Silverthorne in Sununit County (see attached map). Applicant <br />seeks downstream, alternate points of diversion at the Mathis Wells 1 through 6 on the Blue River <br />for the senior irrigation rights decreed to the Roberts and Rouse Ditches on Boulder Creek. <br />Applicant also seeks a plan for augmentation to replace out-of-priority depletions from in-house and <br />stock watering uses i1t the Mathis Wells with releases of water stored in Green Mountain Reservoir. <br /> <br />The Board holds the following instream flow decrees which could be injured by this application: <br /> <br />Case No. <br /> <br />Stream <br /> <br />Amount <br /> <br />Aooroo. Applicant agrees to limit cumulative diversions of its 3.5 cfs interest in the Rouse Ditch and <br />its 1.302 cfs interest in the Roberts Irrigating Ditch, at the historic points of diversion and <br />at the Mathis Well 1-7 alternate points of diversion, to irrigation uses and the amount of <br />water physically available and in priority at the original points of diversion. <br /> <br />. Diversions for in-house and stock watering purposes, which are out-of-priority vis-a-vis the <br />Board's rights, may not be adequately augmented by the onsite ponds and augmentation <br />water in Green Mountain Reservoir as contemplated by the Applicant's augmentation plan. <br />Therefore, Applicant agrees to curtail out-of-priority diversions under the proposed plan for <br />Augmentation at such times as the flows in the Blue River are at or below the decreed <br />instream flow amounts. <br /> <br />. Pursuant to C.R.S. S 37-92-502(5), Applicant shall install, maintain and monitor at locations <br />determined by the Division Engineer, and at Applicant's expense, such measuring devices <br />deemed necessary by the Division Engineer to administer the terms of this decree.
