For more information on water security go to: http://www.eoa.gov/safewater/securitv/. <br /> <br />EPA Trying to Raise Awareness On Water Efficiency: iThe EPA has announced it is planning a <br />national program to promote water-efficient products. The EP A believes water-efficient products meeting <br />current standards can reduce home water use by 30 percent and many products on the market exceed <br />those standards. Water-efficient products for commercial use can save up to 20 percent, and opportunities <br />exist in the industrial sector as well. EP A is evaluating var,ious public information tools to help raise <br />awareness of the importance of water conservation and thq growing demands placed on America's water <br />supplies and water infrastructure systems. ' <br /> <br />One of the tools under consideration is a water efficient prpduct-Iabeling program based on EP A's Energy <br />Star program. i <br /> <br />The EP A intends to hold a series of stakeholder meetings beginning on Oct. 9 in Washington, D.C., to <br />discuss approaches and partnership opportunities. Mike Leavitt Nominated To Be New EPA Administrator: President Bush has announced his <br />intent to nominate Governor Mike Leavitt of Utah as Administrator of the Environmental Protection <br />Agency (EP A). <br /> <br />New Federal ISF Requirements? The Ninth Circuit Court affirmed instream flow requirements imposed <br />by the U.S. Forest Service and National Marine Fisheries Service (NMFS) as conditions on special use <br />permits for irrigation ditch rights-of-way in Okanogan Coqnty v. NMFS. <br /> <br />Our Attorney General has filed an Amicus Brief in the cas~ stating that, "for more than a century, water in <br />a state's boundaries has been handled under state law. Whether the United States Forest Service can obtain <br />water for its own use by requiring the owner of an existing water supply facility located in a national <br />forest to forego exercising part of its water right as a condi~ion of renewing its special use permit...is an <br />issue of great importance to Colorado and other western st~tes, since more than 50 percent of the available <br />water in the West either originates in or flows through nati~mal forests." <br /> <br />In an unpublished August 14 decision, the Ninth Circuit CPurt of Appeals affirmed a district court <br />decision that instream flow conditions imposed under a special use permit for ditch rights-of-way across <br />U.S. Forest Service (USFS) lands did not deny the users their state-vested water rights. <br /> <br />This decision follows a March 2002 District Court decision that rejected claims that the Forest Service <br />lacked the authority to restrict the use of two ditches in Okanogan County in Washington.
