Evans <br />Director, CWCB <br /> <br />TO: Colorado Water Conservation Board Members <br /> <br />FROM: Larry Lang <br /> <br />DATE: March 23, 1999 <br /> <br />SUBJECT: Agenda Item 5, March 29-30, 1999 Board Meeting-- <br />South Platte River Floodplain Project, Right-of-Way Action <br /> <br />INTRODUCTION <br /> <br />At the November 6-7, 1995, Board Meeting, approval was given to grant requests for easements <br />in CWCB's right-of-way along the Chatfield Downstream Channel Improvement Project on a <br />case-by-case basis. The Board has received a request from the Mountain Miser Kayak School for <br />an easement over land owned by the CWCB as part of the Project, adjacent to the South Platte <br />River to use the land to access and exit the River as part of the School's kayaking classes. The <br />School will conduct these classes through the Board's Union Avenue boat chutes. See <br />Attachment A. <br /> <br />DISCUSSION <br /> <br />The Mountain Miser Kayak School requests an easement for ingress and egress to/from the South <br />Platte River in connection with conducting kayak classes through a 900 foot stream reach of the <br />South Platte River channel. The instructors and students will access the river reach through <br />designated ingress and egress points. There are a number of CWCB project features and <br />previous easements granted within the requested easement area. <br /> <br />Use for the Requested Area is for ingress and egress to/from the Riuver at designated points <br />along the River as part of conducting kayaking classes from April 1 through October 1 of each <br />year. If granted, the easement will not restrict any future easements/activities within the CWCB <br />project ROW. <br /> <br />Conditions for the Easement - If the easement is granted, the grantee shaH comply with the <br />foHowing conditions: <br /> <br />1) <br /> <br />TIME PERIOD - The EASEMENT shaH be for a term of 5 years with renewal <br />provisions. <br /> <br />1 <br />
