Re~uired Water ConserV~tion Plan. . <br />(a) The applicant, if not eligible for an exemption, shall <br />submit for approval two copies of a water conservation <br />plan. Prior to submission of the plan in the appli- <br />cation, the applicant or his representative shall discuss <br />the scope and content of the plan at a preapplication <br />conference. At the applicant's request, and to the <br />extent that personnel are a~ailable, the executive <br />administrator may provide e~ucational material and <br />technical assistance in de~eloping a comprehensive water <br />conservation plan that is designed to meet existing and <br />anticipated local needs and conditions. The executive <br />administrator shall review ~ll water conservation plans <br />submitted as part of an application for financial assis- <br />tance for a project and shall determine if the plans are <br />adequate. The long-term water conservation plan shall be <br />consistent with the guidelines for water conservation <br />planning available from the executive administrator. The <br />plan shall serve as the baSis for developing and i~ple- <br />menting a conservation progtam. At a minimum, the plan <br />shall consider, and as apprepriate include, each of the <br />elements in S363,52(bl (12) ef this title (relating to <br />Required General InformatiOn). Reasons for not including <br />any of the elements stated in S363.52(b) (12) of this <br />title (relating to Required General Information) Shall be <br />clearly stated. The plan shall effectively address the <br />follQwing' <br />(1) need for and goals of . water conservation program; <br />(2) methods to reduce water consumption; <br />(3) methods to reduce the loss or waste of water; <br />(4) methods to improve efficiency in use of water; and <br />(5) methods to increase the recycling and reuse of <br />water. <br />(b) The noard may not require an applicant to provide a water <br />conservation plan if the board determines an emergency <br />exists, the amount of financial assistance to be provided <br />is $SOO,OOO or less, or implementation of a water conser- . <br />vation program is not reasonably necessary to facilitate <br />water conservation. <br />(1) An emergency exists when: (A) a public water system <br />or wastewater system has already failed, causing the <br />health and safety of the citizens served to be <br />endangered; (B) sudden, unforeseen demands are <br />placed on a water system or wastewater system (i.e., <br />because of military OPerations or emergency <br />population relocation); (C) a disaster has been <br />declared by the governor or president; or (01 the <br />Governor's Division of Emergency Management of the <br />Texas Department of Public Safety has deter~ined <br />that an emergency exists. (2) The Board shall <br />review an application for which an emergency is <br />determined to exist six months after the board <br />commits to financial assistance, and also at the <br />time of any extensions of the loan commitment. If <br />the board finds. that the emergency no longer exists, <br />it may then require SUbmission of a water <br />conservation plan satisfactory to the board, be fora <br />making any further diSbursements on the commitments. <br />(31 Submission of a plan is not necessary to facilitate <br />water conservation if the applicant already has a <br />program in effect that meets the requirements of <br />Subsection (al of this ection and of S363.85 of this <br />title (relating to Water Conservation Program <br />Prerequisites) . <br /> <br />. <br /> <br />. <br /> <br />. <br />
