(c) The hoard may not require a pro~T3.nt or water conser.alian to he adoptrd under
Subsection (b) of this section if:

(I) an emerltencr ex.. L_ a.. determined by the board;
(2) the amount of financial ""sistance to be prn\"ided is $50n.000 or less; or
(3\ the applicant demonstrates and the board finds that the submission of such a
program. is not reasonably necessary to facilitate conservation or conservation mca~
sures.

water consel'\'ation plans required br this section and other sections of this code.
