Colorado Water Conservation Board
Centennial Bldg., Room 720
1313 Sherman
Denver, CO &0203

Dear Chuck,

e

Regarding the Instream Flow Recommendations in Division 2 which will be presented to the
Colorado Water Conservation Board for col1$ideration at its next regular meeting in Glenwood
Springs, Colorado on July 8-9, 1996. A$ you know the Southeastern Colorado Water
Conservancy District is currently working with staff memb~ of the Colorado Water
Conservation Board and the Attorney Generals Office on the applications of the United States
Fo~t Service for instream flows in Division 2. There are many stream segments in the CWCB
recommendations which duplicate the USFS claims.

Randy Seaholm and other members of your staff are currently developing information regarding
the USFS claims and attempting to set a meeting of a technical group to continue negotiations
with the USFS. I believe the first meeting of the technical group to address the USFS claims will
include stream segments which appear on the list of CWeB Instream Flow Recommendations.

I believe it would be prudent for the Board to move cautiouslv on the Instream Flow
Recommendations in Division 2. The Board should not proceed with the recommendations at
this time and should allow their staff and others involved in the ne o' a . ons sufficient time to
. investigate the duplications on its reco . and the USFS claims, and any implications
from such duplication that may affect the negotiations with the USFS.

If you have any questions or if I can be of any assistance, don't hesitate to contact me.

Sincerely.

~S~~

Tom Simpson
Water ResoUICe Manager

e

cc: Alan Hamel
Steve AIveschoug
Board ofDirectoIS SECWCD
