The state treasurer is <br />hcreby authorized and directed to transfcr two million dollars ii'om the Colorado '.vatO!' <br />conservation board construction fund to the small project loan fund. <br />(2) (a) The Colorado water consen'iltion board is authorized to make loans ii'om the small project <br />loan flmd ili a maximum amolmt of one hundred thousand dollars for slllitll pr-ojects if it <br />detormiIle:J that delay would result in undue hard:Jhip on the bOD'O',ve1'. These loans shall not <br />require prior get10!'al assembly approval, and shall be approved by the board for the p:lrpOSC of <br />"voiding und',\(J delay in completion of tho proj ect. <br />Ch) The total amount of loans from tho small project loan fund shall no: ellcood one million <br />dollars in any ,fiscal ytlar. <br />(3) Tho board shall submit to the general assembly a writtoo determination of the basis for each <br />loan from the small projeot loan fund no: later than December 1 of the year in whioh the loan was <br />~ <br />(4) Tho moneys in the small projeet loan fund are hereby contiR'clously a]fpropriated to tho board <br />for loans in compliance with subsections (1) to (3) ofthis section. All interost derived from the <br />invcstment of moneys in the small project loan fund &hall be credited to the Colorado 'Nater <br />eonsor'latiofl board oOllstruotion fund. /I,n)' balanoe remaining ill the small projoot loan fund at <br />th,e end of an)' fiscal year shall remain in tho fund and shall not revert to tho Colorado water <br />conservation board oonstruction fund. <br />(l~) (a) There is hereby created in the state treasury the feasibility study small grant fund for the <br />pmpose of making small grants to help pay the costs of preparing water project feasibility <br />studies, The Colorado water conservation board shall approve small feasibility study grants based <br />solely on criteria adopted by the board. <br />(b) The state treasurer is hereby authorized and directed to transfer two hundred thousand dollars <br />from the Colorado water conservation board construction fund to the feasibility study small grant <br />fund, The moneys in the feasibiiity study small grant fund are hereby continuously appropriated <br />to the board for grants in compliance with this subsection (l~). All interest derived from the <br />investment of moneys in the feasibility study small grant fund shall be credited to the Colorado <br />water oonservation board construction fund, Any balance remaining in the feasibility study small <br />grant fund at the end of any fiscal year shall remain in the fund and shall not revert to the <br />Colorado water conservation board construction fund, <br /> <br />37-60-122 Colorado Revised Statutes, is amended to read: <br />37-60-122. General assembly approval. (l) Funds in the Colorado water oonservation <br />board construction fund shall be expended in the following manner and under the following <br />drcamstances: <br />(a) Repealed. <br />(b) The general assembly may authorize such projects as it deems to be to the advantage <br />of the people of the state of Colorado and shall direct the board to prooeed with said projects in <br />the priorities established by the general assembly under terms approved by the general assembly. <br />THE COLORADO WATER CONSERVATION BOARD IS AUTHORIZED TO MAKE <br />LOANS WITHOUT GENERAL ASSEMBL Y APPROVAL IN AMOUNTS NOT TO EXCEED <br />ONE MILLION DOLLARS ($1,000,000). THE BOARD SHALL SUBMIT A WRITTEN <br />DETERMINATION OF THE BASIS FOR SUCH PROJECT LOANS TO THE GENERAL <br />ASSEMBLY BY JANUARY 15 OF THE FOLLOWING YEAR IN WHICH THE LOAN WAS <br />MADE.
