22. Stream and Lake Protection Section - New Appropriation Recommendations in Water .
Division 4
Tape 2, Track 2 00:23:49 - 02:06:04
Action: A motion was made by Russell George and seconded by Don Schwindt to
approve staff's recommendation that the Board reinitiate the appropriation
proceedings in the North Fork Basin, incorporate the Staff changes shown in the
table below as reflected in the revised tabulation, and adopt the modified hearing
schedule provided below. The modified recommendations were partially in
response to the North Fork Water Conservancy District (NFWCD) letter which
expresses a desire to work with the Board in their pursuit of upstream
augmentation reservoirs, the Board further recommended that the Staff from the
Construction Fund Loan Program meet with NFWCD staff to discuss options to
utilize the construction fund to aid in the development of future augmentation in
the basin. The motion was amended by Tom Sharp and seconded by Carl Trick
to vote on each stream separately.

Stream Original Modified Recommendation
Recommendation
Muddy Creek 56 (03/15-07114) 56 cfs (04/01-06/30)
(tributary to Paonia 25 (07115-11/14) 17 cfs (07/01-03/31)
Reservoir) 19 (I 1115-03/14)
Anthracite Creek 54 (04/01-07114) No Change
39 (07/15-08/14)
17 (08/15-03/31)
Coal Creek 21 (02/15-03/31) No Change
39 (04/01.07/14)
21 (07115-11114)
18 (I 1115-02/14)
Williams Creek 0.25 (01101-12/31) Recommendation dropped*
Muddy Creek 3.8 (05/01-08/14) Recommendation dropped due to water
(tributary to 0.5 (08/15-04/30) availability
Crawford
Reservoir)
Smith Fork 7.7 (03/01-03/31) No Change
Gunnison River 12.9 (04/01-07/31)
7.7 (08/01-11114)
6.5 (I 1/15-02/29)
South Fork Smith 4.1 (03/15-04/14) Stream segment shortened and lower terminus
Fork 6.4 (04/15-07/31) moved upstream to the Saddle Mountain Ditch
Gunnison River 3 (08/01-11/14)
2.4 (I 1115-03/14)

*While the model does not indicate water availability problems on Williams
Creek, further analysis indicates otherwise. Specifically, based on site visits and
conversations with the water commissioner and landowner, the recommended
year round instream flow of 0.25 cfs does not appear to exist at least 50% of the
time.

Flood Protection.
