Background

At the November 6.7, 1995 and the January 24.25, 1996 Board Meetings, several easements across CWCB Rights-
of-Way along the-Chatfield Downstream Channel Improvement Project were approved by the Board, Following the
approvals, the Board directed staff to develop a fee structure to be used as consideration for CWCB granting of
easements,

At the March 23, 2005 Board meeting, staff was requested by the Board to review and make a recommendation
regarding the existing fee structure for the "Chatfield Downstream Channel hnprovement Project Easement Fee,
Structure' dated March 6, 1996,

Discussion

The CWCBstaff consulted a number of entities regarding a fee for Real Estate Easements and has
discovered that most of these entities use an impact approach procedure in the determination of a fair and
equitable cost to the grantee, In addition to the staff update of the "Easement Fee Structure" dated May
13,2005, the staff finds that it is necessary to implement a review fee for processing all easement request
in the amount of five hundred dollars,

To assist in the administration of Board duties and responsibilities for the Chatfield Downstream Channel
hnprovement Project (project), which has proven to be a very valuable project, the staff proposes that all
revenues collected from the Project be deposited in the South Platte Operational and Maintenance
Account.

Recommendation

The staff recommends that the Board review and approve:
a, Recommendation as stated in the Easement Fee Structure date May 13, 2005-See Attached
Easement Fee Structure dated May 13, 2005;
b, Authorization for the CWCB to collect a five hundred (500,00) review fee; and
c, Depositing of all collected revenues in the South Platte Operational and Maintenance
Account.
