<br />Tribe against FPC which was decided by the Court of Appeals of the <br />District of COlumbia, which would apparently give the Federal Power <br />Commission the right to issue licenses for electric generating plants <br />which use water that is impounded in federally constructed reservoirs. <br />This has a tremendous and I think very dangerous implication to all <br />of us involved in the Colorado River Basin, particularly the Upper <br />Colorado Basin. I will get together with Mr. Billhymer, Mr. Bloom I <br />and SOme of the attorneys from the other states. This matter has <br />now been remanded to the Federal Power Commission. The Federal Power <br />Commission dismissed the application of the Indians to require the <br />FPC to license the Four Corners projects and a number of other proj- <br />ects, Kaparowits, Navajo, MOhave, the San Juan plant and the Hunting- <br />ton plant of Utah Power and Light. The Federal Power commission <br />dismissed it, saying it didn't have jurisdiction under the law. The <br />Court of Appeals had upheld the Federal POwer Commission on about <br />four of the points raised by the plaintiffs, but on the last one <br />which has to do with the utilization of "surplus waters". It may be <br />that the Colorado River Basin states will want to take a position <br />before the Federal Power commission to point out the hazards of <br />requiring yet another agency to license projects which we have always <br />thought were not r.equired. <br /> <br />I recently did a study on compact administrations which I have sub- <br />mitted to the director. It has been so recent that I haven't had a <br />chance to discuss it with him. There may be some revisions required <br />in it and when it is completed I think it will be submitted to the <br />board for consideration. I think this is all I have, Mr. Chairman. <br /> <br />Mr. Vandemoer: I have a question, Ray, but it is <br />you just discussed. Mine is a different subject~ <br />and Judge Carpenter, I assume we would have rules <br />now. <br /> <br />not on the matters <br />On the South Platte, <br />and regulations by <br /> <br />Mr. Moses: Let me report on that and some other people here that are <br />involved in that may have some later or more accurate information. <br />After many days of hearings, the Court requested all of the interested <br />parties to file proposed stipulations and findings and decrees. <br />Originally they were to be filed by December 4, but one of the parties <br />got and extension to December 24. So they are not all in yet' and the I <br />judge has not taken any action on them at the present time. There <br />has been no decision in that case and whether there will be one <br />before next irrigation season, I don't know. <br /> <br />Mr. Vandemoer: As a layman, Ray, does that mean that he asked lawyers <br />to write up how they think the river should be run? <br /> <br />-22- <br />
