<br />e <br /> <br />tit <br /> <br />e <br /> <br />9b. <br /> <br />9c. <br /> <br />lOa, <br />&b. <br /> <br />(2) <br /> <br />Appropriate, based on these determinations, the recommended instream <br />flow water rights on the stream listed in the attached notices, said <br />appropriations being for such waters a have been determined to b required <br />for minimum stream flows to preserve the natural environment to a <br />reasonable degree. <br /> <br />(3) Request the Attorney General's Office to file the necessary water rights <br />applications. <br /> <br />The motion was seconded by William Brown and approved unanimously (7- <br />0). <br /> <br />lnstream Flow Program - New Appropriations - Phase III - Board Action- <br />Division 2 <br />Tape 1, Start/Stop: 4041 - 6300 <br />Tape 2, Start/Stop: 0001 - 0130 <br />Action: Alan Hamel recused himself from consideration of the Tennessee Creek <br />discussions. A motion was made by Patricia Wells that the Board request <br />the Attorney General's Office to make determinations (see 9a language <br />above) on these 5 stream segments (Tennessee Creek and the 4 segments of <br />Fourmile Creek), but not to file applications yet, as the staff will bring these <br />5 segments back to the November Board Meeting. There was an amended <br />motion which was discussed and withdrawn. The original motion was <br />seconded by David Smith and approved urtanimously (6-0). A second <br />motion was made by Patricia Wells that the Board accept the staff <br />recommendations that the instream water rights in the remaining segments <br />listed in the attachments be appropriated, and request the Attorney General's <br />Office to file the necessary water rights applications. The motion was <br />seconded by William Brown and approved urtanimously (7-0). <br /> <br />Instream Flow Program - New Appropriations - Phase ill - Board Action- <br />Division 4 <br />Tape I, Start/Stop: 3988 - 4036 <br />Action: A motion was made by Patricia Wells that the Board accept the staff <br />recommendation (see 9a above) to appropriate the recommended instream <br />flow water rights on the streams listed. The motion was seconded by <br />William Brown and approved urtanimously (7-0). <br /> <br />Instream Flow Program - New Appropriations - Phase III - Public Review and <br />Comment - Divisions 4 and S <br />Tape 1, Start/Stop: 0000 - 0000 <br />Action: There was no request for public comment, so there was no time taken for <br />this item. <br /> <br />Minutes September 21-22, 1998 <br />
