At the January 2005 Board meeting, a Mount Carbon Metropolitan District (Mount Carbon) legal <br />representative from Ciliberto & Associates, LLC., made an appeal for water storage space in the proposed <br />. 20,600 acre-foot watcr supply pool. <br /> <br />The appeal requested that Mount Carbon receive 100 percent of their 1985 conditional water storage decree of <br />800 acre-foot. After presentations and some discussion, the Board asked if Mount Carbon was in a position to <br />accept the 100 acre-feet offer originally offered from the other water users interested in storage space. Mount <br />Carbon's representative said she was not and the Board denied the Mount Carbon request for 800 acre-foot of <br />storage space. Following the Board action, the Attorney General's Office and Mount Carbon have been <br />communicating regarding any storage space in the proposed Chatfield Reservoir storage pool. To date no <br />official response has been received from Mount Carbon. <br /> <br />Project Activities <br />The Board staff, in cooperation with the Attorney General Office, has prepared a final "Letter of Commitment" <br />(letter) and the letter has been mailed to the sixteen water users that received storage space in the Water Users <br />Subcommittee allocation process. The Board is receiving signed letter of commitment from the water users and <br />the Director is executing the "Letter of Commitment" upon the receipt. Staff anticipates receiving the <br />Feasibility Cost Share Agreement (50/50 cost share agreement between the CWCB and the Corps) planning <br />funds from the local water users at part of this "Letter of Commitment" by the June 30, 2005 deadline set forth <br />by the CWCB. <br /> <br />In addition, the Corps, in cooperation with DNR and the Board staff, is completing EIS scoping activities for the <br />commencement of further detailed recreational and environment investigations for impacts of the proposed <br />additional storage space in the Chatfield storage space feasibility study. <br /> <br />. <br /> <br />Requested Action <br />No Board action is requested, as this is an informational agenda item. <br /> <br />Flood Protection.
