The basis for filing was to protect its instream flow, appropriated by the
Board in Case No. 4-80CW109, from inundation. We are not aware of whether the
applicant, Mt. Emmons Mining Company, has complied with the Board Rules
governing inundation which requires the applicant to apply for permission to inundate
an instream flow within 120 days from first applying for a new water right.

.

High Country Citizens' Alliance respectfully requests some time on the agenda at the
Board's March 10-11,1998 meeting to address this issue and to also discuss what might be
considered appropriate mitigation if and when permission to inundate is requested.

Sincerely,

~~

Steve Glazer, Board member

REG "
_.t ....:.....l

FEa 13 1998
CoColorado Water
nse"",~oo Beano!

.

P.O.
