MR. SPARKS: That's correct, because the statute is

explicit. It requires contractual arrangements satis-

factory to the Board. There has to be a final contract

signed. If we don't sign that final contract, there's

no project and that's the sole discretion of the Board.

MR. McDONALD: So that would be point number one.

Point number two, I have a very clear understanding with

both committees on the Senate and House side and with

Senator Anderson personally with respect to this project

that the Board must approve ultimately that project, and

if we do not, we will not proceed.

MR. JACKSON: On that premises I'd move for approval.

excess due to inflation so that would be 100 percent
