<br />3. Water Rights Which Are Elements of the E/A Plan:

<br />A. The Storage Water Rights which are elements of the EIA Plan include: McPhee and
<br />Groundhog Reservoirs.
<br />
<br />(1) McPhee Reservoir:
<br />
<br />(a) Location: The initial point of survey of the high water line of the reservoir is
<br />located at a point whence the Northwest comer of Section 1, T38N, RI6W, N.M.P.M., bears North
<br />08050' West, a distance of3,540 feet. The axis of McPhee Dam is described as follows:
<br />
<br />The Northwest corner of Section 1, T38N, RI6W, N.M.P.M., bears North 8050'
<br />West a distance of3,540.0 feet from a point on the North end of the axis of the _
<br />dam from whence the axis of the dam bears South 33040' East. Its crest width is ..
<br />about 40 feet wide and approximately 1,300 feet long, and the height above stream
<br />bed is about 268 feet.
<br />
<br />The Great Cut Dike, which diverts water into McPhee Reservoir, is located about
<br />5 miles upstream from McPhee Dam. The axis of the Great Cut Dike is described
<br />as follows: The Northwest corner of Section 35, T38N, RI6W, N.M.P.M., bears
<br />North 40'26' West a distance of2,280.0' from a point on the North end of the axis
<br />of the dike from whence the axis bears South 18026' West. The crest of the dike
<br />is about 30 feet wide and approximately 1,900 feet long, and the height above the
<br />lowest point of the ground surface is about 62 feet.

<br />McPhee Reservoir is located in portions of Sections 5, 6, 7, 8, 9,16,17 and 18,
<br />T37N, RI5W, Sections 1 and 2, T37N, RI6W, Sections 2, 3, 4, 5, 6, 7,17,18,20,
<br />21,28,29,30,31 and 32, T38N, RI5W, Sections 12,25,35 and 36, T38N, RI6W,
<br />and Sections 27, 34 and 35, T39N, RI5W, of the N.M.P.M., in Montezuma
<br />County, Colorado.
<br />
<br />McPhee Reservoir is fonned by McPhee Dam and the Great Cut Dike which are
<br />located on the Dolores River, about 10 miles below the Town of Dolores. The
<br />Dam and Dike are both earth and rock fill structures. The reservoir has a total
<br />capacity of 381 ,000 acre-feet ("AF") of which 229,000 AF is active capacity.
