IfReouired: <br /> <br />(1) If the Application is for a surface diversion. and notice must be given to the DWR, <br />DWR and/or the State Engineer shall have AD Application approval, with written notice to the District <br />within 30 days of submittal by the District, unless the District receives court approval for the <br />Application. <br /> <br />(2) If the Application is for a well and AD Applicant receives preliminary District approval <br />for the well to come under this E/A Plan, AD Applicant shall have furnished the District with a well <br />pennit issued by the State Engineer prior to receiving final District approval of the well to come under <br />this E/A Plan. <br /> <br />H. Notice to Parties and Partv Consent: <br /> <br />(1) The District shall give notice to the parties. through their attorneys listed in paragraph <br />2 above, or to any future attorney or representative otherwise identified in writing by the party to the <br />District. <br /> <br />(2) Any party required to receive notice hereunder may waive notice or change the address <br />to which notices are sent by infonning the District, in writing, at the address stated above, and filing <br />a copy of the written waiver or change of address with the Water Court. <br /> <br />(3) The notice to parties required hereunder shall include a summary of the Application for <br />augmentation water and such supplemental infonnation as may be submitted with the Application. <br /> <br />(4) The Notice to parties may group AD Applications, including AD Applicantions <br />approved by the District, within a month. <br /> <br />(5) Any party may file comments with the DWR and the District within fifteen (15) days <br />of receipt of notice, except that comments may be filed within thirty (30) days for AD Applications for <br />any use other than a domestic well or may participate in any subsequent proceeding pursuant to the <br />Colorado Rules of Civil Procedure and Unifonn Local Rules for all State Water Court Divisions. <br /> <br />I. The District shall notify the Water Court annually of new Authorized Diversions under the <br />E/A Plan. <br /> <br />J. The District shall maintain a map showing all Authorized Diversions. <br /> <br />CONCLUSIONS OF LAW <br /> <br />9. The provisions of paragraphs 1-8 above are incorporated herein. <br /> <br />10. This Court has jurisdiction over these proceedings and over all persons and water rights affected <br />thereby, whether they have appeared or not. <br /> <br />13 <br />
