<br />. <br /> <br />. <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />as published in a newspaper of general circulation in the EI A Plan area, is 21 % or less: <br /> <br />(1) The well owner shall cease all irrigation from a well augmented hereunder. <br /> <br />(2) The well owner shall curtail all well diversions augmented hereunder, including those <br />for in-house use, unless the well owner complies with the following provisions: <br /> <br />(a) The owner timely stopped all well diversions for irrigation, in accordance with the <br />DWR Notice; and <br /> <br />(b) The owner augments the Dolores River or the appropriate tributary at or near the <br />diversion augmented hereunder from a cistern, pond or tank on well owner's property or by tanker truck, <br />in an amount and on a schedule necessary to replace depletions for in-house use calculated pursuant <br />to Exhibit " c..,. " hereunder satisfactory to the Division Engineer at a rate to be determined by the <br />Division Engineer. <br /> <br />J. The District shall notify the Water Commissioner, District 71, as soon as practicable after the <br />District is aware that there will not be a 100% Dolores Project water supply for the current irrigation <br />season. The District will further inform the water commissioner of the date the first Dolores Project <br />water user must reduce diversions because of a shortage of Project water. <br /> <br />K. Not enoul!h water in Groundhol! Reservoir: In the event the storage and release of the 400 <br />AF in Groundhog Reservoir becomes unavailable or unfeasible because of dam failure, water shortage, <br />or any other natural or regulatory event, the District shall have no responsibility to repair Groundhog <br />Reservoir and no liability under the Upstream Agreement and the MVICIDWCD Agreementto provide <br />replacement water hereunder, until such time as the ability to store and release such water has been <br />restored, if ever. However, as long as MVIC is able to obtain the MI&D water to which it is entitled <br />pursuant to its contracts with the District, MVIC shall not place a call on the Dolores River System. <br /> <br />8. Imolementation of the Plan and Inclusion of Additional Authorized Diversions Under this E/A <br />Plan: This E/A Plan will be implemented according to the following procedures: <br /> <br />A. The seventy-four (74) wells listed in Exhibit "B" are deemed "Authorized Diversions." <br /> <br />B. Water uses, in addition to those listed in Exhibit "B," may become part of this E/A Plan only <br />with the express written permission of the District, in compliance with District Rules and Regulations, <br />and the approval ofthe Water Court, Water Division 7, unless deemed approved pursuant to the terms <br />and conditions herein. <br /> <br />C. Applicants for an Authorized Diversion under this E/A Plan ("AD Applicants") shall submit <br />an application ("AD Application") and appropriate fees and supplemental information to the District, <br />on forms approved by the District and DWR, which forms may be supplemented or amended from time <br />to time to meet continuing requirements of the Stale Engineer. The AD Application shall identify this <br />EI A Plan as the source of replacement water to prevent injury to other water rights. <br /> <br />9 <br />
