<br />- 2- <br /> <br />The vision for the Manual is: <br />. Develop a Manual that provides engineering standards for Colorado Users; <br />. Strike a reasonable balance between protecting public safety and the cost of drainage <br />improvements; <br />. Enhance the health, safety, and welfare of the citizens ofthe state of Colorado through reduced <br />flood damages; <br />. Reduce the cost for preparation and review of drainage analysis and design; <br />. Provide compatibility and consistency between user agencies; and <br />. Reduce drainage liability risk through the use of important non-technical sections (policy, <br />drainage law, floodplain management submittal, and others). <br /> <br />Staff will provide at the July meeting a brief summary of the 2-hour workshop presentation that was <br />given at the March 2004 meeting in order to refresh the Board regarding these principles and to better <br />inform the new Board members about this Agenda Item. <br /> <br />Revisions since March 2004 <br />Board members provided to Staff at the November 2003 and March 2004 meetings several suggestions <br />regarding the Manual's Operating Principles. Those suggestions have all been considered and <br />addressed at this time. In addition, Staff has consulted with the Attorney General's office and the <br />Manual's Technical Advisory Committee in order to solicit additional input, revise language, and gain <br />concurrence with the 12 Operating Principles for the Manual as presented herewith. Staff examined the <br />following Operating Principles carefully after input and suggestions were received from the parties <br />mentioned above: <br /> <br />Discrepancy Resolution (Operating Principle #1) <br />The basic concept of this Principle is to recommend that government entities in Colorado adopt <br />the Manual at their own discretion, which may include adoption of the entire Manual or portions <br />of the document only. Each entity that chooses to adopt portions or the entire Manual will be <br />responsible for enforcement of the criteria within its jurisdictional boundaries. In the event that <br />any portion of the Manual is in conflict with differing drainage criteria adopted by a local entity or <br />district, the local or district criteria will govern. The CWCB staff and the T AC agree with this <br />Operating Principle, which provides communities with an option to utilized their own criteria in <br />lieu ofthe State's criteria. <br /> <br />Floodways (Operating Principle # 4) <br />The basic concept of this Principle is to reinforce the minimum floodway criteria mandated by <br />FEMA, but also to allow for Colorado communities to adopt and enforce more stringent criteria if <br />they so desire. The FEMA criteria allows for fill and/or development within the 100-year <br />floodplain (flood fringe) that would effectively cause no more than a 1.0 foot rise in the 100-year <br />flood elevation at any point along the stream reach of interest. There are a number of <br />communities that are currently utilizing floodway criteria that are more stringent than FEMA's <br />(and FEMA actually encourages such activity). The intent of the CWCB Manual is to explicitly <br />support a community's option to adopt and enforce floodway regulations that vary from a zero <br />rise criteria (fill and development in the flood fringe that does not impact that toO-year flood <br />elevations at all) up to the minimum FEMA criteria as stated previously.
