William McDoll.lId <br />Din.'('IOr <br /> <br />TO: <br /> <br />Dennis Montgomery <br />Assistant Attorney General <br /> <br />FROM: <br /> <br />Bill McDonald <br />Director <br /> <br />DATE: <br /> <br />September 9, 1981 <br /> <br />SUBJECT: <br /> <br />Request for Advice <br /> <br />This will confirm the Board's request for your advice on the <br />following question: <br /> <br />Will the costs of the four feasibility studies autho- <br />rized by section 7 of SB439 :1981 sessioni count towards <br />the expenditure limitation for feasibility investigations <br />set forth in section 37-60-122 (1) :c), CRS 1973, as amended? <br /> <br />., <br /> <br />The relevant language in 37-60-122 (1) (C) provides that: <br /> <br />For all such feasibility investigations, the Board is <br />authorized to commit or expend on a continuing basis ten <br />percent of the moneys appropriated, credited, or otherwise <br />applied to the construction fund.... <br /> <br />The ten percent provision was added by section 3 of Chapter <br />149, Session Laws of Colorado 1980. Said law became effective <br />on June 5, 1980.
