Applicant's proposed water storage rights will inundate one ofthe CWCB's instream flow segments
on Clear Creek, which may cause injury to the CWCB' s instream flow water right on Clear Creek.

Clear Creek Reservoirs Ltd., L.L.L.P., the City of Aurora, the United States of America
(Department of the Interior, Bureau of Land Management), High Plains A & M, LLC, the
Arkansas River Outfitters Association, the Board of County Commissioners of Chaffee County,
and the Colorado River Water Conservation District also filed Statements of Opposition to this
application.

Contact with Applicant

CWCB Staff and the AG's Office discussed the Board's inundation procedures with the Applicant's
attorney, who informed Staff that the Applicant's proposed reservoir enlargement project is at an
early stage of development and that the Applicant intends to further evaluate certain aspects of the
project before submitting a request to inundate to the CWCB.
