'\

3T Cattle Company
May 24-27. 2004

Agenda Item 21b

these rights are close to 50 years senior to the well. GASP has successfully been used for the .
past 30 years to cover the depletions on the well. 3TCC needs to develop its own source of
augmentation by the August deadline in order to keep using the well.

Consumptive use for 10,000 head of cattle would be approximately 90 t0112 acre-feet annually,
based on daily consumptive water use for cattle calculated at 8 -10 gallons per animal. Therefore
3TCC is seeking CWCB funding to purchase 5 shares of Weldon Valley Ditch water to use for
augmentation. 3TCC is considering several options for either submitting their own Substitute
Water Supply Plan to the State, or joining an existing augmentation group plan such as Central
Colorado Water Conservancy District or Orphan Wells of Wiggins, LLC.

Feasibilitv Studies

Brent M. Nation, P.E. of Fort Morgan has completed the feasibility study in accordance with CWCB
guidelines. The study includes an assessment of alternatives on how to generate augmentation
water supply for 3TCC.

3T Cattle Comoanv

3TCC is a Colorado corporation in good standing, incorporated in 1972. The corporation was
organized for the purposes of livestock production and sales, real estate investment, construction
contracting, and other similar business activities. In recent years the company's financial activities
have been primarily leasing of the feedlot operation and several other rental properties in Fort
Morgan and Denver. Current officers and shareholders of the company are Kevin Averch,
President and Rachel Averch, Secretary, and the principal offices of the corporation are located in .
Fort Morgan, Colorado.

Water Riahts

For the feedlot, 3TCC currently has only the water right decreed for the one well. The well pumps
up to 120 acre-feet of water annually for a full feedlot. The water for the proposed purchase is a
direct flow right decreed as follows:

Weldon Valley Ditch (5 shares)

Decree Date
10/26/1881

Estimated Deliverv
38 AF/share (Gross)
18-20 AF/share (Consumptive Use)

The total estimated consumptive use delivery of the rights is 90 to 100 acre-feet. A thorough
consumptive use analysis will be performed to determine the exact usable amount and timing for
augmentation. Preliminary analysis based on gross pumping compared to gross deliveries
indicates an adequate correlation. The purchase price of the Weldon Valley shares is $54,000 per
share. (For comparison, in 2003, Central Colorado Water Conservancy District paid $50,000 per
share for 8 shares of Weldon Valley Ditch.)

Proiect Descriotion

A range of alternatives were considered on how to generate an augmentation supply for 3TCC:

1. The no-action alternative.
2. Purchase senior water rights to use for augmentation.
3. Construct recharge ponds filled using a junior water right.

.
