happens? Does the Attorney General make a
report back to this Board and then this
Board makes the determination as to whether
or not an appearance should be made or what
is the purport of the resolution? That's
the thing I am a little vague about."

MR. BARNARD, JR.: "From a purely technical standpoint - I
say the Attorney General makes a decision -
that's not exactly true. The statute pro-
vides that the state may appear by the Attor-
ney General on the requirement of the Gover-
nor, and from a purely technical standpoint
it would be the Governor's decision to make,
I believe. However I this would be based on
a recommendation from the Attorney General.

As a practical matter, of course, it
will be worked out, as I say I between our
office, ~~. Sparks and the staff, and Mr.
Moses. As a practical matter, this is the
way it is.

I think the purport is to call attention
to the fact that this is an important thing
and should be expedited and a decision made
as soon as possible."

MR. NELSON: "Mr. Miller has moved an amendment to the
recommendation and that amendment is that the
Director of the Water Conservation Board and
the Attorney for the Water Conservation Board
participate. The amendment was not seconded."

MR. BURR: "Yes, I seconded both the motion and the
amendment."

MR. BARNARD, JR,: "I'll accept the amendment."

MR. NELSON:

"Then the motion we are voting on is this
recommendation amended to inclUde the Direc-
tor and the Attorney of the Water Conserva-
tion Board. All in favor of the motion say
'yes'; all opposed say 'no' - the motion is
carried.
