<br />e <br /> <br />e <br /> <br />e <br /> <br />133 <br /> <br />Con~ntAgendah~2q <br />Case No. 5-00CW307; Richard Butera <br /> <br />Application Swmnarv <br /> <br />This is an application for an augmentation plan near the City of Aspen (see attached map). The <br />Applicant seeks a junior swface diversion for domestic, irrigation, stockwatering, fire protection, <br />augmentation and exchange pmposes. In addition, the Applicant seeks a junior water storage right <br />for the same uses. Moreover the Applicant seek an augmentation plan that would augment a well <br />that would be applied for in the future, with water released from the new junior pond. <br /> <br />CWCB Appropriations <br /> <br />The Board holds instrcam flow water right for the Castle Creek in the amounts of 12 cfs with an <br />appropriation date of 1/14/76. The Board also holds instream flow water rights on the Roaring Fork <br />for 55 (4/1-9/30) and 30 cfs (1O/1-3/31) and 145 (4/I-9/30) and 75 cfs (101l-3/31) for two different <br />segments of the Roaring Fork River, both with an appropriation date of 11/8/85, which may be <br />injured by this application. <br /> <br />Potential for Iniury <br /> <br />This applioation may not replace the depletions in time place and amount and thus may cause injury <br />to the Board's Castle Creek and Roaring Fork River instream flows. <br /> <br />Other Obiectors <br /> <br />The other objector in this case is the City of Aspen. <br /> <br />IIDENVER2\CWCBIWCTRANSISECC\Case files\20001S0OCW307 _rnem.doc <br />
