The water right was decreed in <br />1984 and has an appropriation date of 7/13/1984. <br /> <br />In order to prevent injury to CWCB rights the Town will limit direct flow diversions of its senior <br />municipal water rights at the alternate pOints of diversion to the amount physically and legally <br />available at the original Bear Creek site and to times when the CWCB instreamflow in the upper San <br />Miguel River is satisfied. <br /> <br />2. REQUEST TO ADD MUNICIPAL USE TO INDUSTRIAL WATER RIGHTS <br /> <br />e <br /> <br />The second requested change of water rights involves the addition of municipal water use to <br />several of the Town's senior direct flow and storage water rights in Bridal Veil Cleek that were <br />historically used for mining and milling purposes. Tha addition of municipal use to the senior <br />decrees will allow the Town to continue to use the Bridal Veil water system when the Town's <br />,aiternate points Of diversion become limited due to physical or legal constraints. Use of,the senior <br />decrees for this purpose will not increase the overan depletion attributed to the rights. The Town <br />proposes to include terms and conditions in'the decree that will limit It's water treatment plant <br />diversions under the senior rights to only the historic consumptive use levels, not the historic <br />diversion amounts. By limiting it's municipal intake under the senior rights to consumptive use <br />only, the Town will prevent any possible Injury to eWCB rights. <br /> <br />3. WATER RIGHTS EXCHANGE <br /> <br />When a call has been placed on the upper San Miguel River and the Town has exceeded the <br />historic consumptive use credits available under the senior industrial water rights, a water rights <br />exchange is proposed that would allow the Town to continue diversions from the Bridal Veil Creek <br />basin. Under the proposed exchange, the Town would continue to divert and use water under it's <br />senior, Bridal Veil Creek water rights.
