We were advised that the CWeB staff
would recommend denial ofthe original request for an easement because ofthe proposed
deck's proximity (approximately 12 feet) to the east edge of the bike/pedestrian path,

Revised Request. Based on our discussions with the CWeB staff, we have
revised our request for an easement as follows:

1, The proposed deck would be constructed with an 18-foot setback
from the east edge of the bike/pedestrian path, which would then be approximately 26
feet from the west edge ofthe bike/pedestlian path,

2. The proposed deck would not be a permanent structure; rather it
would be constructed in such a way as to allow for prompt disassembly and removal.

3, We would agree to remove the proposed deck in the case of
emergency upon seven (7) days notice from the CWeB staff.
