<br />Special Review Uses <br /> <br />In the 1975 model regulations, development in the <br />floodplain was prohibited in- general and then some exceptions <br />were made for certain uses in the low hazard area. However, <br />there was not a precise delineation of prohibited uses and <br />allowed uses. In the revised model regulations, certain <br />specified uses are prohibited and other specified uses are <br />allowed once a permit appllcation has been completed and appli- <br />cable standards met. The remaining uses are in a third category, <br />special review uses. They require case-by-case review to deter- <br />mine whether they should be allowed or prohibited. <br /> <br />Roles of Administrator, Permit Authority and Board <br />of AdJustment <br /> <br />The 1975 model regulations provided for a public hearing for <br />any floodplain use before the _ "designated official or agency". <br />That was essentially the only guidance which the model regula- <br />tions providen on administrative procedures. <br /> <br />The revised model regulations set forth the roles and <br />responsibilities of the Administrator who carries out the less <br />controversial portions of the regulations, the Permit Authority <br />which has the authority to enforce and interpret the regulations, <br />and the Board of Adjustment which hears appeals and requests for <br />variances. The revised model regulations make the procedures <br />short and straightforward for allowed uses so that the Adminis- <br />trator can efficiently issue permits. They make the procedures <br />more thorough, without requiring a public hearing, for special <br />review uses, for which the approval of the Permit Authority is <br />required. Finally, the variance and appeal procedures are <br />clarified from the 1975 model regulations. <br /> <br />Relation to Underlying zoning <br /> <br />The 1975 model regulations did not explain the zoning <br />concept upon which the regulations are based. The revised model <br />regulations clarify the fact that the regulation of floodplains <br />is in addition to the existing requirements of zoning author- <br />ities. In other words, a use in the floodplain must satisfy both <br />the underlying zoning requirements and the overlaying floodplain <br />regulations. <br /> <br />Mobile Homes <br /> <br />In the 1975 model regulations, there were no specific <br />requirements for mobile homes as distinguished from other <br />structures. The revised model regulations have a separate <br />section regarding mobile homes, both in mobile home parks and on <br /> <br />-2- <br />
