A <br />1313 Sherman <br />Denver, CO 80203 <br /> <br />Re: Boss Lake Reservior <br /> <br />Dear Jeris: <br /> <br />Last month, several reoresentatives of the Uooer <br />Arkansas Water Conservancy District met with you to di1cuss the <br />District's proposal for a feasibility study of Boss Lake <br />reservoir. At that meeting, Assistant Attorney General Dennis <br />Montgomery raised the question of whether the proposal <br />satisfied the criteria of C.R.S. 1973, 9 37-60-121(b)(I) or <br />(II) which guide the use of the Colorado Water Conservation <br />Board construction fund. This provision states: <br /> <br />(b) In the consideration of making <br />expenditures from the fund, the board shall <br />be 9".J.ided by the following cri teri.a: <br /> <br />(I) Approximately two-thirds of the moneys <br />available to the fund shall be devoted to <br />projects which will increase the beneficial <br />consumptive use of Colorado's compact <br />entitled waters; <br /> <br />(II) The balance of the moneys available to <br />the fund shall be devoted to projects for <br />the repair and rehabilitation of existing <br />water storage and delivery systems; <br /> <br />The District believes that the Boss Lake proposal meets both of <br />these guidelines. <br /> <br />Initially, it should be noted that Boss Lake is a <br />state reservoir authorized by legislation enacted in 1899 and <br />now se~ forth in C.R.S. 1973, S 37-88-108 (1981 Cumulative <br /> <br />EXHIBIT "B" <br />
