The District <br />expects to seek a conditional decree for Boss Lake (perhaps <br />with the State as a co-applicant). This study would provide <br />some of the information needed for that filing. <br /> <br />The study would also add~ess the potential beneficiaries <br />of the Boss Lake project. The District has already been <br />contacted by the City of Ponc~a Springs and others regarding <br />the use of the facility. We expect that Boss Lake would be <br />used for storage by exchange of Fryingpan Arkansas waters for <br />the benefit of municipal, industrial and agricultural users <br />within the district. This study will assist the district in <br />assessing various possibilities for use of Boss Lake, including <br />exchanges. <br /> <br />II I. Conclusion <br /> <br />The Upper Arkansas District proposes to spend up to <br />$25,000 on the Boss Lake study. We request that the Board <br />authorize expenditure of 50% or up to $12,500. As set forth on <br />Exhibit B, we believe this proposal clearly satisfies the <br />criteria set by the legislature for use of the Board's funds. <br />It should be noted that the recent Boss Lake statute itself <br />specifically mentions the use of Construction Fund money for <br />Boss Lake. <br /> <br />Lastly we urge the Board to consider that the reservoir is <br />a state owned structure which should not be allowed to fall <br />into disrepair and to be without benefit to the public. Also, <br />by statute, the Board is directed to encourage conservancy <br />districts and the Boss Lake project is the Upper District's <br />first substantial effort to aid its constituents.
