On July 1, 2005, transfers $4,000,000 from the Operational Account of the Severance <br />Tax Trust Fund to the Legal Costs Fund. <br />. Provides the Department of Law with continuous spending authority to pay Kansas for its <br />legal costs, not to exceed $4,000,000, and subject to the written approval of the JBC or the <br />State Controller. <br /> <br />Litieation Account: Work continues on the litigation support activities being funded by the <br />Board through the litigation account ofthe construction fund_ The required annual report to <br />the General Assembly is being drafted and will be submitted before the end of this fiscal <br />year. During the last two months we have resolved reporting and billing procedures with <br />CSU for the irrigation and weather station components. Several new weather stations have <br />been installed, and a few more rehabbed. Maintenance procedures have been established and <br />are being implemented. The second year of field scale irrigation monitoring has commenced. <br />A finallysimeter design consultation was held on May 3 with CSU, DWR, CWCB, and the <br />consultants from Texas A&M. Preliminary cost estimates were reviewed and will be <br />finalized by CSU shortly. It appears that construction of the first, and larger, of the two <br />proposed lysimeters will exceed the budget for this activity and that DWR will have to find <br />funds for construction of the second, or reference, lysimeter. Hal Simpson has begun the <br />process of seeking federal financial assistance from USDA Agricultural Research Service in <br />consultation with our Congressional delegation. <br /> <br />Arkansas River Basin Water Forum: The 2005 Arkansas River Basin Water Forum Annual <br />Program, entitled "Cool, Clear Water" was hosted by the Purgatoire River Water Conservancy <br />District (PRWCD) on April 7-8 in Trinidad. The Board helped sponsor the Forum with a $1000 <br />contribution, and distributed information about SWSI, and an ongoing study of aquifer properties <br />in the area. Board member Harold Miskel attended and met with many water users from <br />throughout the Basin. Agenda items included sessions on the history of Trinidad and the <br />Purgatoire Water Conservancy District, -~ panel on coal bed methane drilling and its impacts, and <br />- sessions on domestic groundwater wells, water for wildlife, agricultural and municipal water <br />conservation, and water quality. Todd Doherty presented a session on instream flows. Tours <br />included Trinidad Dam and State Park. <br /> <br />Russ George Submits 2005-2006 Flow Recommendation for the Upper Arkansas: Every <br />year DNR cooperates with Reclamation and the Southeastern Colorado Water Conservancy <br />District (SECWCD) in the implementation of an annual flow program to support fisheries and <br />rafting in the Upper Arkansas River. A part ofthis participation includes specific flow <br />recommendations for management on the river. The recommendations are intended to provide <br />an annual flow regime that helps maintain the brown trout fishery, meet the demand for boating <br />recreation, and support the region's tourism industry while allowing the managers of the <br />Arkansas Headwaters Recreation Area to meet their obligation to manage recreation and natural <br />resources within the area's boundaries. <br /> <br />The 2005 - 2006 recommendations were submitted to the Bureau on April 13 by DNR. This <br />highly successful program strikes a careful balance between the sometimes competing needs for <br />fishery and boating flows, and is only possible through the voluntary cooperation of the <br />SECWCD, Reclamation, and other major water users who agree to time water operations to <br />assist the flow program_ The local rafting industry makes a financial contribution to offset any <br />water lost as a result of re-timing river operations. <br /> <br />19 <br />
