This segment has been noticed pursuant to Rules 5.21, <br />5.22, 5.24 and Rules 5.50 - 5.56, and the public was afforded an opportunity to comment pursuant to <br />those Rules. The proposed stream segment is located in San Miguel County and is listed on the <br />attached Instream Flow Tabulation Summary Table. <br /> <br />Pursuant to Rule 5.52, four parties filed a Notice to Contest the Specie Creek recommendation. The <br />parties are: Trout Unlimited, Jon & Joanne Corzine, John & Victoria Irwin, and Wolf Land <br />Company. <br /> <br />CWCB and AGO Staffs worked with representatives of all the parties participating in the Specie <br />Creek instream flow recommendation. The parties all have agreed to the language in the attached- <br />signed stipulation. At its July meeting, the Board granted the Hearing Officer the authority to <br />approve a stipulation containing language providing the same level of protection to the Specie Creek <br />Instream Flow Recommendation as the language provided to the Board in July and to allow the <br />Hearing Officer to vacate the Hearing in this case. The Hearing Officer has approved the attached <br />stipulation and vacated the Hearing. Staff is now asking the Board to make the final determinations <br /> <br />e <br /> <br />Flood Protection.
