Hefley introduced H.R.. 1714 to enact the necessary amendments to . <br />the Fry-Ark legislation and the Board received a copy of the bill. No substantive action on H.R. <br />1714 occurred during 2001. Subsequently, several new elements of the PSOP and the related <br />legislation arose and it became necessary to amend H.R 1714. At the request of the relevant <br />Congressional Committees it was determined to re-introduce the bill, rather than amend H.R <br />1714. H.R3881 is the new bill containing the several new provisions needed to better reflect the <br />proposed modifications to the Fry-Ark Project. <br /> <br />{, <br /> <br />Discussion <br /> <br />H.R 3881 contains 3 main sections. <br />· The first is introductory, containing an overview of purposes and limitations. <br />· Section 2 authorizes the Secretary of Interior to undertake enlargement studies of Pueblo <br />Dam and Reservoir and Sugar Loaf Dam and Turquoise Lake to be funded by the SECWCD <br />and consistent with the PSOP. ' <br />· Section 3 adds several new provisioJIS' to the existing Fry-Ark authorizing legislation. <br />· Authorizes long term contracts with agencies:within the SECWCD service area to utilize <br />excess capacity in project facilities for storage and delivery of non-project water. <br />· Authorizes temporary contracts with any agency operating a water bank to utilize project <br />facilities for storage and delivery of non-proj ect water. <br />· Contains provisions related to use of revenues generated pursuant to new contracts. . <br />· Exempts such contracts from provisions of the 1982 Reclamation Reform Act. <br />· Contains limitations on expanded use of nativ:e and Colorado River water. <br />· Authorizes contracts for up to 25 years with City of Aurora to utilize excess capacity in <br />project facilities for storage and delivery of non-project water. <br />· Authorizes contracts for up to 25 years with Pueblo West Metro District to utilize excess <br />capacity in project facilities for storage and delivery of non-project water. <br /> <br />The Board can review the provisions ofH.R 3881 wJ;lich is attached and ask questions during <br />the discussion which will be led by Mr. Miskel. <br /> <br />Recommendation <br /> <br />This item is informational only, no action is recommended at this time. <br /> <br />. <br />
