<br />'J <br /> <br />. <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />98CW278 <br />Water Div. 1 <br /> <br />At a minimum the accounting reports shall provide for weekly accounting of the Bear Creek <br />Reservoir storage level, diversions to storage, evaporation loss and releases or diversions from <br />storage. The accounting reports shall also distinguish between "operational" and "non-operational" . <br />administration of Bear Creek Reservoir. Operational administration occurs when the reservoir level. <br />drops below the crest of the morning glory spillway (5558.1 m.s.!.; a.k.a. a staff gage reading of <br />38.1 feet), requiring the Corps of Engineers to pressurize the outlet structure and operate its control <br />gates to regulate the outflow from the reservoir. <br /> <br />N. The applicant has adequately set forth a fmding of reasonable diligence, therefore <br />the conditional right is continued with an appropriation date of August 29, 1970 (2000 AF) and <br />October I, 1970 (1989 AF), provided that the water is diverted and applied to beneficial use within <br />a reasonable time;. subject, however, to all earlier priority rights of others and to the integration and <br />tabulation by the Division Engineer of such priorities and changes of rights in accordance with the <br />law. <br /> <br />O. An application for a. Finding of Reasonable Diligence shall be filed in <br />, 2005, 'and every 6th calendar year thereafter so long as the applicant desires to <br />maintain this conditional water right or until a detennination has been made that this conditional <br />water right has become an absolute water right by reason of the completion of the appropriation. <br /> <br />IT IS ACCORDINGLY ORDERED that this Ruling shall be filed with the water clerk <br />subject to judicial review. <br /> <br />4 <br />
