Agenda Item 18
May 24-25, 1999 Board Meeting
Page 2 of2

I

.

a statement of opposition. Staff and the City of Thornton have reached a stipulation in
this case that would allow the Board to maintain diligence in these cases. That settlement
is contingent upon the State of Colorado maintaining an accounting of storage in Bear
Creek Lake Reservoir as described in the proposed decree attached hereto. This
accounting is provided by the Division of Water Resources has part of their nonnal day-
to-day administration of water rights on Bear Creek. This settlement also allows the
necessary time to complete the reallocation studies that the Corps, the State of Colorado
and other entities have initiated on Chatfield and Bear Creek Lake Reservoirs.

e

Recommendation

Staff recommends that the Board approve the stipulated settlement with Thornton and the
proposed decree attached hereto which contains the stipulated tenns and conditions as
requested by Thornton.

Attachment:

e

e
