<br />- " <br />,j <br />t -'1'0; <br /> <br />. <br /> <br />. <br /> <br />Staff shall initially present, in such detail as found necessary by the Board, the factual <br />basis for its recommendation. At a minimum, staff shall describe the basis for finding: <br /> <br />e <br /> <br />. That the natural environment will be preserved to a reasonable degree by the <br />water available for the appropriation to be made; <br />. That there is a natural environment that can be preserved to a reasonable degree <br />with the Board's right, if granted; and <br />. That such environment can exist without material injury to water rights. <br /> <br />. Interested persons may, after completion of questions from the Board, have an <br />opportunity to question staff about its recommendation. Such questions shall be relevant <br />and shall not be repetitive. Length and scope of such questioning shall be in the <br />discretion ofthe chainnan of the meeting. <br /> <br />. Upon request, the Board may allow interested persons to question those who have <br />commented if the chainnan of the meeting believes such questioning would materially <br />assist the Board in reaching a decision. Length and scope of such questioning shall be in <br />the discretion of the chairman of the meeting. <br /> <br />. <br /> <br />Each interested person shall have an adequate opportunity to comment, orally or in <br />writing, upon the staffrecommendation. Such comment may include statements of <br />consultants or other experts knowledgeable about the proposal. Visual aids may be used <br />in the presentation of comments, and shall become a part of the record of the <br />proceedings. The Board may establish time limits on presentations. Length and scope of <br />an individual's comments may be limited in the discretion of the chairman of the meeting. <br /> <br />e <br /> <br />. The Board will act on the proposed Instream Flow Recommendations by: <br /> <br />. Approving the Recommendations; <br />. Rejecting the Recommendations; <br />. Modifying the Recommendations; <br />. Tabling the Recommendations; or <br />. Taking any other action the Board feels is appropriate. <br /> <br />. The Attorney General will file with the Water Court water rights applications for <br />approved Instream Flow Recommendations. <br /> <br />. The November Board meeting is the last regularly scheduled opportunity for the Board to <br />approve Instream Flow Recommendations in any adjudication year.
