<br />Consent Agenda Item lb <br />Case No. 5-0lCW287; Bruce Benson <br /> <br />Application Summary <br /> <br />This is an application for storage water rights, a change of water rights, and a plan for augmentation. <br />The proposed change is of the Saums Ditch from irrigation use during the irrigation season to year- <br />rowld storage for augmentation purposes and temporary storage prior to use for irrigation on the <br />same lands that have been historically irrigated. The Applicant's diversions occur on Brush Creek <br />tributary to the Blue River, near Green Mountaul Reservoir (see attached map). The augmentation <br />plan contemplates augmentulg the depletions on Brush Creek with dry-up credits associated with the <br />Saums Ditch. <br /> <br />CWCB Appropriations <br /> <br />The Board holds ulstream flow water rights on Brush Creek, decreed Ul Case No. 5-87CW298 for 3 <br />cfs (year-round), with an appropriation date of 1/19/1977 and on the Blue River, decreed Ul Case No. <br />5-87CW298 for 125 cfs (5/1-9/30), 90 cfs (10/1-11/30), 85 cfs (12/1-2/29), and 90 cfs (3/1-4/30) <br />with an appropriation date of 10/2/1987. <br /> <br />Potential for Iniurv <br /> <br />The CWCB's ulstream flow water rights on Brush Creek and Blue River may be u1jured If the <br />Applicant does not replace its out-of-priority depletions Ul time, place and amOWlt. <br /> <br />Other Obiectors <br /> <br />The other objector Ul this case is the City of Colorado Springs. <br /> <br />L\Boardmem\May 2002\ConsentAgendaItemNo 1 b.doe <br />
