MOSES, WITTEMYER, HARRISON AND WOODRUFF, P. C.

Mike Serlet
September 11,2001
Page 2

.

remainder of2001 and the first half of2002 is $120,000 ($45,000 in legal expenses and $75,000 in
engineering expenses). As you can see, LA WMA anticipates incurring substantial additional
expenses in responding to Kansas' allegations and in preparing for trial of this case.

Accordingly, LA WMA hereby requests that the CWCB allow it to defer the $122,000
payment on Loan No. C 153 715 that will become due on:May 1, 2002 to free up funds to prepare for
the Kansas v. Colorado trial. Since most of the $122,000 payment on Loan No. Cl5371S is made
up of interest, LA WMA would prefer to calculate a new loan amortization schedule which would,
as I understand it, add tothe principal ofthe loan the interest that accrues during the period in which
this loan is deferred.

LA WMA truly appreciates your prompt attention to this matter. Richard Mehren,
my associate, and I are both working on this. If you have any questions, do not hesitate to give
Richard or me a call.

Very truly,

.

MOSES, WITTEMYER, HARRISON AND
WOODRUFF, P.C.

BY~

David L.
