Please find enclosed <br />my Record of Decision for your information and files. <br /> <br />, <br />The decision to deny your request for a Colorado weather modification permit was made <br />after a thorough review of the facts. The information in your application and information <br />provided at the public hearing in Lamar on April 2, 1996 was carefully compared against the <br />criteria set forth in the Colorado statutes at Section 36-20-112 (3)(a-h). The application failed to <br />meet the requirements of three criteria (a,b, and h). <br /> <br />The differefice ii1 reviewing your permit this year '..vas a separate exarn.ina.tion of the effects <br />ofthe program in the operational area in Kansas and in Colorado. The pJ;incipal reason for the <br />denial is there are no intended benefits to the people in the operational area in Colorado or to the <br />people of the State of Colorado. <br /> <br />If the program could be re-fomiulated to include a definite identifiable benefit in Colorado, <br />we will reconsider your application. I suggest that the first step would be to work with water <br />user groups in Colorado and our agency to design a program in Colorado. <br />
