<br />19. . The decision to issue a Colorado weather modification permit is based on the criteria <br />in S 36-20-103, CRS as it applies to that part of the operational area located in <br />Colorado. <br /> <br />20. Based on the infonnation in the proposed operational plan, testimony provided at the <br />public hearing, and the materials reviewed, and considering the proposed operational <br />area in Colorado, the project: <br /> <br />A is a commercial project which is scientifically and technically feasible [ S 36- <br />20-112 (3)(c), CRS], <br /> <br />B. does not involve a high degree of risk of substantial harm to land, people, <br />health, safety, property, water rights, or the enviror1l11ent [ S 36-20-112 (3)(e), <br />CRS], <br /> <br />C. includes adequate safeguards to prevent substantial damages to land, property, <br />water rights, people, health, safety, or the environment [ S 36-20-112 (3)(f), <br />CRS], and <br /> <br />D. will not adversely affect another weather modification project [ S 36-20-112 <br />(3)(g), CRS]. <br /> <br />21. Under the Act, no permit may be issued unless .the director determines that, if it is a <br />commercial project, the proposed weather modification operation is conceived to <br />provide, and offers promise of providing, an economic benefit to the area in which the <br />operation will be conducted [ S 36-20-1)2 (3)(a), CRS]. The term "operation" <br />means the performance in Colorado of any activity to attempt to modifY or having the <br />effect of modifying natural weather conditions... [ 9 36-20-104(4), CRS].(Emphasis <br />added). No evidence was presented in the proposed operational plan, testimony <br />provided at the public hearing, or the materials reviewed, to show that the project <br />offers a promise of providing, or is conceived to provide, economic benefits to the <br />operation area located in the State of Colorado. <br /> <br />22. Under the Act, no permit may be.issued unless the director determines that the project <br />is reasonably expected to benefit the people in the area in which the operation will be <br />conducted or benefit the people of the state of Colorado [ S 36-20-112 (3)(b), CRS]. <br />No evidence was presented in the proposed operational plan, testimony provided at <br />the public hearing, or the materials reviewed, to show that the project is reasonably <br />expected to benefit the people ofthe State of Colorado. <br /> <br />. 23. Under the Act, no permit may be issued unless the director determines that the project <br />is designed to minimize risk and maximize scientific gains or economic benefits to the <br />residents of the area or the state [ 9 36-20-112 (3)(h), CRS]. Based on the <br />information in the proposed operational plan, testimony provided at the public <br />hearing, and the materials reviewed, the project was' shown to be designed to <br />rriinimize risk to the residents of the operation area located in Colorado or the State <br /> <br />7 <br />
