<br />3. The sponsor of the proposed project is the said District. The proposed project will <br />be managed by the District through its Western Kansas Weather Modification <br />Program ("Program"). <br /> <br />4. The person proposed to be in charge of the project for the District is Curtis D. Smith, <br />Program Manager, who holds a valid Colorado weather modification license for <br />calendar year 1995. <br /> <br />5. The permit application review fee of$100.00 has been paid by check No. 5060 dated <br />February 12, 1996. <br /> <br />6. Proof of fmancial responsibility has been provided by the applicant by means of a <br />Certificate ofInsurance dated March 21, 1996, which evidences that the applicant is <br />covered by single limit injury and property damage liability insurance in the amount <br />of$l million through Reliance Insurance Company ofIlIinois, which operates under <br />United Pacific in Colorado. <br /> <br />7. Fourteen counties in the State of Kansas have entered into an agreement with the <br />applicant to jointly finance the weather modification operations in 1996 to increase <br />rainfall and reduce crop-damaging hail. Participation in the Program is voluntary on <br />a county by county basis. Since the inception of the Program in 1975, 16 different <br />Kansas counties have participated in the Program for various reasons at one time or <br />another, and 6 counties have participated continuously. <br /> <br />8. The applicant has requested a 60-mile wide fly-over area in Colorado. In 1995, a 35- <br />statute mile wide area was allowed. <br /> <br />9. Colorado's Weather Modification Act of 1972 ("the Act"), at S 36-20-112(1)(d), <br />CRS, does not specifically address special requirements for interstate weather <br />modification permits.. However, the State of Kansas is in support of the project, has <br />issued a permit for the project, and does not prohibit. weather modifications <br />operations to be carried on in Kansas for the benefit of Colorado or its inhabitants. <br />[ 936-20-118, CRS] <br /> <br />10. Legal notice of intent to modify weather was published on March 14 and March 21, <br />1996 in the official newspapers of Kit Carson and Baca Counties, on March 15 and <br />March 22 in the official newspapers of Kiowa and Prowers Counties, and on March <br />21 and March 28 in the official newspaper of Cheyenne County.
