Monte <br />Pascoe, Executive Director, Colorado Department of Natural Resources. <br /> <br />FINDINGS OF FACT <br /> <br />1. Because the permit application was substantially the same as for <br />the 1978 program conducted for Western Kansas Groundwater Management <br />District #1 upon which a hearing had been held, the Director determined <br />that a hearing was unnecessary pursuant" to review 'and permit renewal. <br /> <br />2. The Findings of Fact were predicated upon the careful review and <br />consideration of the following: <br /> <br />a) The Application for Permit for Weather Modification Activities, <br />Form WM2, dated March 17, 1980 with an attached map. <br /> <br />b) The Application for Permit for Weather Modification Activities, <br />Form WM2, dated April 25, 1979 with an attached map. <br /> <br />c) The original Application for Permit for Weather Modification <br />Activities, Form WM2, dated March 16, 1978 with an attached <br />map for which permit was issued May 8, 1978. <br /> <br />d) Public hearing on April 18, 1978 at 10:00 a.m. in Lamar, Colorado. <br /> <br />e) Advice, comments and recommendations of the Weather Modification <br />Advisory Committee tendered to the Executive Director on <br />May 30, 1979 as well as comments subsequent to that date. <br /> <br />f) Weather Modification Act of 1972, Article 20, Title 36, C.R.S. 1973. <br /> <br />g) Written materials and articles submitted by the Applicant. <br /> <br />3. The nature of the proposed program is to undertake a May-August commercial <br />(operational) weather modification program through the use of aircraft to: <br /> <br />a) increase rainfall <br />b) suppress hail <br /> <br />The target area for such a program is entirely outside and east of the <br />State of Colorado. The operator anticipates the necessity of seeding <br />upwind some fifteen miles within Colorado to impact border counties <br />within the target area inside Kansas. Funds for said project are from <br />sources outside the state of Colorado. <br /> <br />4. The Applicant has demonstrated that the person in control of the project <br />regarding seeding within Colorado will be strictly limited to <br />Mr. William J. Carley who possesses a valid Colorado weather modification <br />license. <br />
