<br />\./ <br /> <br />BEFORE THE DEPARTMENT OF NATURAL RESOURCES <br />OF THE STATE OF COLORADO <br /> <br />IN THE MATTER OF APPLICATION OF <br />WESTERN WEATHER CONSULTANTS FOR A <br />PERMIT TO CONDUCT WEATHER MODIFICATION <br />OPERATIONS FOR AND ON BEHALF OF <br />VALLEY GROWERS, INC., OF CENTER, <br />COLORADO <br /> <br />FINDINGS OF FACT <br /> <br />This matter came on for public hearing on December 4, 1975, before John <br />Phillip Linn, Hearing Officer for the Department of Natural Resources, State <br />of Colorado, at Carson Auditorium on the Adams State College, Campus , Alamosa, <br />Colorado. A transcript of the proceedings, prepared by Mary M. Hall, Certified <br />Shorthand Reporter, was received by the Hearing Officer on December 15, 1975. <br /> <br />The following members of the Advisory Committee were present and partici- <br />pated in the hearing: <br /> <br />Dr, Barbara C. Farhar <br />Dr. Hugo Fershau <br />Mr. Lewis O. Grant <br />Mrs. Melba Hastings <br />Mr. lJilliam B. Keating <br />14r. Guy Mock <br />Mr. Bob Taylor <br /> <br />Gerald O. Sjaastad, Deputy Director, Colorado Department of Natural <br />.- Resources, was present at the hearing. <br /> <br />Western Weather Consultants, herein referred to as the Applicant, was <br />represented by Frank E. (Sam) Maynes, Esq., and Larry Malick, Esq., of the <br />firm Maynes and Anesi, Attorneys at Law, Durango, Colorado. <br /> <br />The follOWing witnesses were called by the Applicant: <br /> <br />Lawrence Marvin Hjermstad, Meteorologist <br />Dr, Herbert Owen, College Professor and Plant Ecologist Consultant <br />Don MYers, President, Rio Grande Water, Preservation District <br />Robert W. Felmlee, Secretary-Treasurer, Valley Growers, Inc. <br /> <br />The following persons gave statements in opposition to the granting of <br />the permit: <br /> <br />Glen Bowers, Hinsdale County Commissioner <br />Warren Camerer, Ouray County Commissioner and President of Western <br />Colorado Beet Growers Marketing Association <br />Gene Larson, Minerals Engineering Co., Creede, Colorado <br />John Wilson, Gunnison County Stockgrowers Association <br />Glen Hinshaw, Wildlife Conservation Officer, Creede, Colorado <br />Felix Cordova, Farmer and Rancher, Manassa, Colorado <br />David Root, Southwest Forest Industries <br />John S. Wilder, Esq" County Attorney, Mineral County, Colorado <br /> <br />Mr. Pete Thompson, representing Concerned Citizens for the Preservation <br />of Natural Resources and the cattlemen, was not opposed to granting of the <br />Permit on condition that a committee, discussed infra, would monitor the <br />'project and have the authority to alter or terminate seeding operations when <br />in its judgment damage was bei ng done. " <br />
