FOR A ) <br />PERMIT TO CONDUCT WEATHER MODIFI- ) <br />CATION OPERATIONS FOR AND ON BEHALF ) <br />OF WESTERN KANSAS GROUNDWATER ) <br />MANAGEMENT DISTRICT NO.1, ) <br /> <br />DECISION AND PERMIT RENEWAL <br /> <br />This matter came up for review and permit renewal by <br />Harris D. Sherman, Executive Director, Colorado Department of Natural Resources. <br /> <br />FINDINGS OF FAGT <br /> <br />1. Because the permit application was substantially the same as for the prior <br />year upon which a hearing had been held, the Director determined that a <br />::'negr:mg was~ua.:Bece:ss~r.y.:;parsuant:.:to::,t'!evfew ~nd:"\permfb I1anewal. <br /> <br />2. The Findings of Fact were predicated upon the careful review and considera- <br />tion of the following: <br /> <br />a. The application for Permit for Weather Modification Activities, <br />Form WM2, dated April 25, 1979, with an attached map., <br /> <br />b. The original Application for Permit for Weather Modification <br />Activities, Form WM2, dated March 16, 1978, with an attached <br />map for which permit was issued May 8, 1978. <br /> <br />c. Puhlic hearing on April 18, 1978 at 10:00 a.m. in Lamar. Colorado. <br /> <br />d. Advice, comments and recommendations of the Weather Modification <br />Advisory Committee tendered to the Executive Director on <br />May 30, 1979 as well as comments subsequent to that date. <br /> <br />e. Weather Modification Act of 1972, Article 20, Title 36, C.R.S. 1973. <br /> <br />f. Written materials and articles submitted by the Applicant. <br /> <br />3. The nature of the proposed program is to undertake a May-August commercial <br />(operational) weath~r modification progrgm through the use of aircraft to: <br /> <br />a. increase rainfall <br /> <br />b. suppress bail <br /> <br />The target area for such a program is entirely outside and east of the <br />State of Colorado. The operator anticipates. the necessity of seeding <br />upwidd some fifteen miles .within Colorado to impact border counties <br />within the target area. inside Kansas. Funds for said project are from <br />sources outside the state of Colorado. <br /> <br />4. The Applicant has demonstrated that the person in control of the project <br />regarding seeding within Colorado will be strictly limited to <br />Mr. David J. Spowart, Jr. who lX's~ses a valid Colorado weather modifica- <br />tion license. <br /> <br />S. The Applicant must fUInish a permit fee, as specified in Article 20, <br />Title 36t C.R.S. 1973t before any permit can be issued. The total permit <br />fee in this case shall be $100. <br />
