It is expressly <br />understood that the Bureau does not represent that any or all of the <br />funds in the payment schedule will be appropriated by the Congress or <br />will be reserved for payments under thi s contract, and the Bureau shall <br />not be liable for damages under this contract because Congress fails to <br />appropriate funds or the Bureau fails to reserve funds in accordance <br />with the above estimates. <br /> <br />a. Prior to the effective date of the Appropriation Act, payment for <br />earnings will be made for an interim appropriation under a joint resolu- <br />tion passed by Congress and within such limitations as may be imposed by <br />Congress. The Contractor will be advised of funds which are thus <br />available. After the Appropriation Act is effective, the Contractor <br />will be notified of the sums reserved and available for payments under <br />this contract. <br /> <br />b. If at the end of any fiscal year the Contracting Officer finds that <br />the balance of reserved funds is in excess of the estimated amount <br />required to meet all payments due or to become due to the Contractor, <br />the Contracting Officer may reduce the reservation by the amount of such <br />excess. However, no reduction will be made without appropriate prior <br />consultation with the Principal Investigator. The Contractor will be <br />notified in writing of any such reduction. <br /> <br />c. Objective accomplishment. - If at any time the Contracting Officer <br />considers that the objective of this contract has been accomplished, in <br />part or in whole, either through this contract or other Reclamation <br />contracts, or through research performed by others, the Contracting <br />Officer, after prior consultation with the Principal Investigator, shall <br />have the right to reduce requirements and contemplated funding or to <br />terminate work performance and request preparation of a final report by <br />the Contractor. The Contractor shall be given written notice of such <br />termination. Notwithstanding the provisions of this contract as to <br />estimated reimbursable costs, only such costs as have been accrued by <br />the Contractor before receipt of such notice of termination shall be <br />reimbursed to the Contractor, except costs for the preparation of the <br />fi na I report. <br /> <br />B-2 <br />
