M:Jnte <br />pascoe, Executive Director, Colorado Depa.rtment of Natural Resources. <br /> <br />FINDli'GS OF FIlCT <br /> <br />1. Because the permit application was substantially the same as for the <br />1978 program conducted for Western Kansas Groundwater Management <br />District #1 upon which a hearing had been held, the Director <br />determined that a hearing was unnecessary pursuant to review and <br />permit renewal. <br /> <br />2. 'lhe Findings of Fact were predicated upon the careful review and <br />consideration of the following: <br /> <br />a) <br /> <br />The Application for Permit for Weather Modification Activities, <br />Form ~, dated April 14. 1981. <br /> <br />b) The Applications for Permit for Weather Modification <br />Activities, Form WM2, dated March 17, 1980 and April 2S, 1979. <br /> <br />c) The original Application for Permit for Weather MtXlification <br />Activities, Form ~, dated March 16, 1978 for which permit was <br />issued May 8, 1978. <br /> <br />d) Public hearing on April 18, 1978 at 10:00 a.m. in Lamar, <br />Colorado. <br /> <br />e) Advice, corrments and recommendations of the Weather <br />Modification Advisory COrmnittee tendered to the Executive <br />Director onJMaY 30, 1979 as well as comments subsequent to that <br />date. <br /> <br />f) Weather Modification Act of 1972, Article 20, Title 36, C.R.S. <br />1973. <br /> <br />g) Written materials and articles submitted by the Applicant. <br /> <br />3. The nature of the proposed program is to undertake a May l-August 31 <br />commercial (operational) weather modification program using aerial <br />awlication of silver iodide nucleating material to: <br /> <br />a) increase rainfall <br />b) suppress hail <br /> <br />The target area for such a program is entirely outside and east of <br />the State of Colorado. The operator anticipates the necessity of <br />seeding UfWind some fifteen miles within colorado to impact border <br />counties within the target area inside Kansas. Furrls for said <br />project are from sources outside the state of Colorado. <br /> <br />4. The Applicant bas derronstrated that the persons in control of the <br />project regarding seeding within COlorado will be strictly limited <br />to Mr. William J. Carley arrl Me. English Harrmorrl who possess valid <br />Colorado weather modification licenses. <br /> <br />/" <br />
