Public hearing testimony by Ralph Clark, self employed. <br /> <br />FINDINGS <br />1. The application, operational plan, and liability insurance coverage for a Colorado weather <br />modification permit have been properly presented by Don Griffith North American Weather <br />Consultants, Inc of Sandy, Utah and are adequate to satisfy the state requirements to issue a <br />permit. <br /> <br />2. The sponsors of the project are Gunnison COlll1ty, Dos Rios Water System, Upper Gunnison River <br />Water Conservancy District, Crested Butte MOlll1tain Resort, Town of Crested Butte, Scenic River <br />Tours, City of Gunnison, Gunnison County Stockgrowers Association, Crested Butte South <br />Metropolitan District. John Devore stated that additional water could be produced at $1.00 to <br />$1.30 an acre foot and with recent discussions with East River Water and Sanitation District that <br />there is potential that all local water users will be cooperating and funding this program. <br />Gunnison County will also approach Monarch Ski Resort and the Division of Wildlife Habitat <br />Program for additional support. <br /> <br />3. The person proposed to be in charge for the project sponsors is Don Griffith of North American <br />Weather Consultants of Sandy, Utah. Dong Griffith has provided adequate evidence of his <br />qualifications of professional education and research and operational experience to conduct <br />weather modification operations in Colorado. Don Griffth and NA WC are integral in weather <br />modification operations in Utah, and have previously held weather modification permits in <br />Colorado for the Willow Creek Basin. {s 36-20-112(1)(g), CRS} <br /> <br />4. The permit application review fee of$100.00 has been paid byNA WC to the Colorado Water <br />Conservation Board by check Number 4056 dated December 6, 2002. {s 36-20-1 12(1)(b), CRS} <br /> <br />5. Proof of financial responsibility has been provided by the applicant by means of a Certificate of <br />Insurance that evidences the applicant is covered by a commercial insurer with general liability <br />insurance in the aggregate amount of $2 million through the R.C. Knox Insurance Company of <br />Hartford, Connecticut. The insurance certificate is valid from 10-15-02 through 10-15-03. {s 36- <br />20-1 12(1)(b), CRS} <br /> <br />6. The proposed Operational Plan for the project submitted by the applicant meets the requirements <br />of {s 36-20-1 12(1)(d), CRS}. <br /> <br />7. The areas outside of the target area reasonably thought to be affected by the project are those areas <br />above approximately 9,000 feet inside and immediately adjacent to the target areas. <br /> <br />8. There is potential for operations by North American Weather Consultants to affect operations at <br />the southern most end of weather modification permit operations for the Upper Arkansas River <br />Water Conservancy District, Denver Water Department, and Southeastern Colorado Water <br />Conservancy District (Permit 2002-1) conducted by Western Weather Consultants, LLC of <br />Durango at or near Monarch Pass. <br /> <br />5 <br />
