<br />DECISION'AND PERMIT-Page 2 <br /> <br />2. The prepared program is under the sponsorship of parties listed in <br />Attachment A attached hereto. <br /> <br />3. The nature of the proposed program is to undertake a commercial weather <br />modification program within the project area to provide beneficial additional <br />water supplies for recreational, 'agricultural, municipal, and other uses. <br /> <br />4. The Applicant has demonstrated that the persons in control of the, project <br />received valid weather'IDodification licenses and those persons are Lawrence <br />M.' Hjermstad, Richard A. Medenwaldt, and Curtis L. Hartzell. <br /> <br />5. The applicable permit is $962.04. <br /> <br />6. The Applicant.has furnished proof 'of financial responsibility. <br /> <br />7. The Applicant has submitted an operation plan for the proposed project <br />which plan meets the requirements of C.R.S. 1973, 36-20-ll2(1)(d) and which <br />is incorporated into' these findings be' reference. <br /> <br />8. The'Applicant issued a Notice of Intent to modify, the weather pursuant <br />to the above said hearing in conformance with C.R.S. 1973 36-20-ll2(1)(e). <br /> <br />9. Said Notice of Intent was circulated to County Commissioners and newspapers <br />in the following manner: <br /> <br />a. Notice: of Intent and Permit applications were on file in the <br />office of County-Commissioners in at least five locations well <br />distributed within the affected area. A listing of offices is <br />available in the office of the Executive Director, Department <br />of Natural Resources, 1313 'Sherman Street, #718, Denver, Colorado <br />80203. ' <br /> <br />b. Notice of permit application and scheduled hearings was circulated <br />and published in newspapers in 11 counties. A listing of newspapers <br />is available in the Office of the Executive Director, Department <br />of Natural Resources. <br /> <br />10. The Appliclant has met the requirements of the Weather Modification Act <br />regarding publication. <br /> <br />11. The project is conceived and offers promise of'providing economic benefit <br />to the area in which the operation will be conducted. The recommendation of <br />the Weather Modification Advisory Committee 'supports this finding. <br /> <br />12. The projec~ is reasonably expected to benefit people in the area and <br />benefit the people of the State of Colorado. The recommendation of the <br />Weather Modification Advisory Committee supports this finding. <br /> <br />13. The project is scientifically and technicallj feasible. The recommendation <br />of the Weather Modification Advisory Committee generally supports this finding. <br /> <br />14. The project does not involve a high degree of risk of substantial harm <br />to land, people, health, safety, property, or the environment. The recommenda- <br />tion of the W~ather Modification Advisory Committee supports thi~ finding. <br /> <br />15. The project, subject to the terms and conditions of the permit, is <br />designed to include adequate safeguards to prevent substantial harm to land, <br />people', health, safety, property, or the environment. 'the'recommendation of <br />the Weather Modification Advisory Committee supports this finding. <br /> <br />16. The project will not adversely affect another project, subject to the <br />terms and conditions of the permit. The recommendation of the Weather Modi- <br />fication Advisory Committee supports this finding. <br />
