<br />" <br />I <br /> <br />16. The proposed project is a commercial project and not a research and development <br />project. The snowfall sampling program proposed by some objectors intended to <br />refine the estimates of the magnitude and extent of the seeding operation, is beyond <br />the scope of this commercial weather modification project. <br /> <br />17. Opposition to the application on the basis that the opponent is morally, ethically or <br />otherwise opposed to technology in general or weather modification specifically is <br />not sufficient grounds for denying the application. <br /> <br />18. Opposition to the application from a fear that a strong EI Nino will cause excessive <br />- precipitation to fall in the region is not sufficient grounds for denying the application. <br />The natural variability in snowpack, weather from EI Nino or other natural causes, <br />is taken into account by the application of suspension criteria to the long-term <br />average snowpack measured in the target area. <br /> <br />19. It does not appear that the seeding agent from the proposed weather modification <br />project will contribute to any air pollution problem related to EPA's designated <br />nonattainment area for Telluride based on air quality standards for particulate matter. <br /> <br />20. Based on the information in the proposed operational plan, testimony provided at the <br />public hearing, and the information and materials reviewed in the administrative <br />record, the project: <br /> <br />A. is reasonably expected to benefit the people in the area in which the operation <br />will be conducted by augmenting snow for enhanced operation of the ski area <br />and providing additional snowmelt runoff for irrigation purposes [ ~ 36-20- <br />112 (3)(b), CRS], <br /> <br />B. is scientifically and technically feasible [ ~ 36-20-112 (3)(c), CRS], <br /> <br />C. does not involve a high degree of risk of substantial harm to land, people, <br />health, safety, property, water rights, or the environment [ ~ 36-20-112 (3)(e), <br />CRS], <br /> <br />D. includes adequate safeguards to prevent substantial damages to land, <br />property, water rights, people, health, safety, or the environment [ ~ 36-20- <br />112 (3)(t), CRS], <br /> <br />E. will not adversely affect another weather modification project [ ~ 36-20-112 <br />(3)(g), CRS], and <br /> <br />F. is designed to minimize risk and maximize economic benefits to the residents <br />of the area [ ~ 36-20-112 (3)(h), CRS]. <br /> <br />7 <br />
